Conditions

1. General

These terms and conditions apply to all types of orders (Internet, e-mail, fax, telephone, order card) and also to all future transactions that the customer concludes with Lepore AG. Deviating or supplementary provisions, verbal agreements or conditions of the customer are only recognized if they have been confirmed in writing by Lepore AG. Lepore AG reserves the right to make technical changes and improvements without prior notice. In the case of obvious errors such as spelling or calculation errors, Lepore AG rejects any obligation.

 

2. Contract Types

2.1. operation

2.1.1 Operating Agreement

a) The devices are made available by Lepore AG free of charge for the consumption of corresponding products. The minimum consumption of the agreed quantities must be observed per month.

b) The customer undertakes to purchase all consumable products from Lepore AG without reservation.

c) Service, maintenance and repairs are at the expense of Lepore AG.

d) The customer is liable for any fire, water and theft damage as well as for damage caused by improper operation.

e) The devices and the accessories provided remain the property of Lepore AG without reservation and must be returned immediately after termination of the contract.

2.1.2 Failure to comply with the minimum order quantity

a) The customer undertakes to comply with the monthly minimum consumption quantity per device throughout the contractually agreed term.

b) The average minimum purchase quantity is checked regularly over a period of 6 months.

c) In the event of insufficient purchases, the contractually agreed products that have not been purchased within the last 6 months will be invoiced at the base price, and the difference between the agreed capsule price and the base price of the products already purchased will be charged.

2.1.3 Termination of the Operating Agreement

a) The agreement may be terminated by giving three months' notice prior to the expiration date.

b) After the agreed term has expired, the monthly purchase quantities and the product price defined from them are tacitly renewed for a further year.

c) If the customer terminates this agreement prematurely, the customer undertakes to pay compensation to Lepore AG. The amount of compensation is based on the products not purchased during the agreed term and the loss of sales.

d) This obligation does not apply if the early reason for termination was caused in full by Lepore AG. 

2.2 Purchase

a) When purchasing a device from Lepore AG, the warranty provisions and their duration are recorded on the purchase contract.

b) Repairs caused by improper operation, manipulation, incorrect installation, damage caused by fire, water or theft as well as wear and tear on the housing are excluded from the guarantee.

c) Periodic descaling is excluded from the guarantee.

d) The guarantee expires as soon as modifications or repairs are carried out by unauthorized third parties.

e) The guarantee is only guaranteed if the buyer purchases the products exclusively from Lepore AG.

2.3 Subscription

a) The guarantee includes repairs and free replacement of machine parts due to material and construction errors. All repairs caused by limescale deposits are excluded from the guarantee.

b) The stated guarantee services are valid for the entire term. If you shorten the subscription period, the guarantee is 1 year from the date of purchase.

c) After the subscription has expired, a fixed fee will be charged for each repair.

 

3. Prices and terms of payment

The prices are net, payable within 10 days of the date of the invoice, including the statutory value-added tax. Price changes as a result of adjustments to the statutory VAT rate will be passed on to the buyer without prior notification. Price changes caused by manufacturers or third parties are reserved. These will be communicated to the customer 3 months before the introduction.  

 

4. Online store and website

4.1  Personal data and information that reaches Lepore AG via the Internet is processed by Lepore

      AG, taking into account the applicable data protection law.

4.2 The Internet offers provided by Lepore AG are subject to technical availability,

      in particular with regard to failures due to technical faults.

4.3 Lepore AG rejects any form of compensation. It is the registered user's responsibility to

      to handle the access code to the online shop with care and thus to untrue or unwanted orders by third parties

      impede.

4.4 In terms of an active service, Lepore AG endeavors at all times to process the order from Monday to Friday on

      same day (order received by 3 p.m.) or at the latest on the following day. Orders received on

      weekend or public holidays  will  processed the next working day. The delivery of the ordered products

      takes place without reservation within 24 hours of order processing.

4.5 Lepore AG supplies the devices and products exclusively to customers in Switzerland and the Principality of Lichtenstein

      are resident.

4.6  As a service to visitors, the website may contain hyperlinks to other Internet addresses. These will go through

      Lepore AG controls nor operates.  Lepore AG is not responsible for this website and therefore rejects it  every

      liability for their correctness,  content, legality and function.

4.7 The content of the Lepore AG website is protected by copyright and may not be used without written permission

      used, distributed, modified, transmitted or further used for public or commercial purposes.

 

5. Complaints and Returns

Complaints about wrong or incorrect delivery must be reported to Lepore AG within 3 days of receipt of the goods. Any returns must be in their original packaging, unused,

provided with the return reason and without  any signs of use will be returned. Should any of the above conditions  not be fulfilled, we reserve the right to charge for the items despite the return.

 

6. Shipping Costs

a) The customer pays a share of the shipping costs for each delivery.

b) Return shipping fees due to non-pickup of goods will be passed on to the customer in full.

 

7. Retention of Title

Until the purchase price has been paid, all items and the associated rights remain the property of Lepore AG. In the event of bankruptcy of the customer, Lepore AG is entitled to collect the unpaid goods.

 

8. Privacy

Customer data such as names, addresses, e-mail addresses, personal details and information on payment transactions are used by Lepore AG exclusively to process orders and are not passed on to third parties.

9. Jurisdiction

In the event of legal disputes, the parties agree on the exclusive jurisdiction of the courts in 5620 Bremgarten (AG).
